Wet Reckless vs. Diversion: Which Path Fits a DUI Case?
A wet reckless and diversion are not two choices on the same menu. A wet reckless is a plea to a lesser charge, so it is still a conviction. Diversion pauses a case and can end in dismissal, but California law generally restricts diversion in DUI cases. This guide uses California as the main example.
Quick answer
Wet Reckless vs. Diversion in Short
- A wet reckless is a plea to reckless driving involving alcohol or drugs.
- It needs the prosecutor's agreement and is a conviction.
- Diversion pauses the case and can end in dismissal.
- California Vehicle Code § 23640 generally restricts diversion in DUI cases.
- The DMV license process runs separately.

What a Wet Reckless Actually Is
A wet reckless starts as a DUI charge. Under California Vehicle Code § 23103.5, the case can resolve as a plea to reckless driving, with a note that alcohol or drugs were involved.
- It needs the prosecutor's agreement.
- It is not offered in every case.
- It is a conviction, and it can count as a prior if there is a later DUI.

What Diversion Actually Is
Diversion pauses a case while the person meets conditions, such as treatment, classes or testing. If the conditions are completed, the case can be dismissed. See What Is Pretrial Diversion in California?
California law
Why California DUI Cases Rarely Get Diversion
Vehicle Code § 23640 generally bars courts from suspending DUI proceedings for diversion. Courts have debated whether judge-granted misdemeanor diversion under Penal Code § 1001.95 or mental health diversion under Penal Code § 1001.36 can still apply. Current case law matters.

Outside California
Outside California, DUI Diversion Varies
Some states offer DUI diversion and others restrict it. The National Highway Traffic Safety Administration notes that diversion and plea agreements can affect whether a DUI shows up as a prior. Ask a local attorney.

What a Wet Reckless Does Not Fix
- Your license. The DMV process runs separately from the court case.
- Future exposure. It can count as a prior for a later DUI.
- Your record. It is still a conviction. See California Clean Slate Act for record relief basics.

Questions to Bring to Your Attorney
- Is there a weakness in the evidence?
- Do I have a prior within the lookback period?
- Does this prosecutor's office offer a wet reckless?
- Is any other charge in my case eligible for diversion?
- What will the DMV do regardless of the plea?
- Can I show I am already meeting likely probation conditions? See AB 541 Program.
Legal note
California DUI law and case law change. Whether a wet reckless or any diversion is available depends on the case, the prosecutor and the court. Only your attorney can advise you. Treatment records do not guarantee any outcome.
